Photo Contest Rules

1. TERM:
   The Erickson Air-Crane Photo Contest ("Contest") BEGINS AT 12:00:00 AM (US Pacific) ON SEPTEMBER 15, 2011 and ENDS AT 11:59:59 PM (US Pacific) ON OCTOBER 31, 2011.
2. SPONSOR:
   Erickson Air-Crane Incorporated ("Erickson"), 5550 SW Macadam Ave., Ste 200, Portland, OR 97239.
3. WHO MAY ENTER:
   The Contest is open to the general public worldwide who are at least eighteen (18) years old as of Sept 15, 2011, except employees (and their immediate families and members of the same household) of Erickson Air-Crane, their affiliates, agents, and advertising and promotion agencies. Contest is void where prohibited by law.
4. HOW TO ENTER:
   Entrant must follow the instructions as posted on Erickson's website (www.ericksonaircrane.com). Complete an entry form with the required information, including the entrant's name, address, telephone number, email address, and photo caption and submit with a photograph in accordance with the instructions.
   
   Each photograph submitted must contain an Erickson Air-Crane S-64 Aircrane Helicopter. The photograph must be submitted to the Contest Gallery found on Erickson's Site in the form of a PNG or JPG file no smaller than 1200 pixels on the longest side and no larger than 5 megabytes. Only online entries will be accepted. No hard copies of the entry will be accepted. Entrants may enter a maximum of two (2) photos (duplicate entries are not allowed).
   
   Each photograph submitted (i) may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, or unlawful, as determined by Erickson in its sole discretion, (ii) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Erickson in its sole discretion, (iii) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights, or involve physical harm to any person or animal, (iv) may not include any viruses, worms, corrupt files, trojan horses, or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest, (v) may not use any distinguishing artist marks or watermarks (such as any prominent signature or symbol representing the artist), and (vi) if found to be in violation of these rules will be disqualified and therefore removed from the Contest Site Gallery.
   
   By entering the Contest, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph.
   
   If a submitted photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.
   
   ENTRIES MUST BE RECEIVED BY 11:59:59 PM (US Pacific Time Zone) on October 31, 2011.
5. SELECTION OF WINNERS:
   Winners will be selected on or about October 20, 2011, from all eligible and qualified entries. Three winners will be selected. Only one entry per entrant may be chosen as a winning entry. Odds of winning depend on number of eligible entries received.
6. PRIZES:
   There will be one (1) 1st Place Prize, one (1) 2nd Place Prize, and one (1) 3rd Place Prize awarded, consisting of the following:
   
   • 1st Place Prize Package: One (1) Erickson S-64 Aircrane model (1:78 scale), one (1) large Erickson duffle bag and one Erickson visor.
   • 2nd Place Prize Package: One (1) Erickson Flight Jacket, one (1) small Erickson duffle bag and one (1) Erickson cap
   • 3rd Place Prize Package: One (1) Erickson Air-Crane sweatshirt and one Erickson cap.
   
   All prizes will be awarded (assuming sufficient number of entries). Erickson reserves right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. Erickson will not replace any lost, mutilated or damaged prizes.
7. LICENSE:
   By entering the Contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Erickson to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including, but not limited to publication on Erickson's website or other promotional materials. Display or publication of any entry on Erickson's website does not indicate the entrant will be selected as a winner. Erickson will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Erickson the unrestricted right to use all statements made in connection with the Contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Erickson will not be required to pay any additional consideration or seek any additional approval in connection with such use.
8. LIMITATION OF LIABILITY:
   By entering this Contest, all entrants agree to release, discharge, and hold harmless Erickson and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
9. GENERAL
   This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of Oregon, USA. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the State of Oregon. Erickson Air-Crane is not responsible for late, garbled, incomplete, misaddressed, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Erickson Air-Crane is not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. Erickson disclaims any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Erickson's reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. Sponsor reserves the right, in their sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliates if the entrant's fraud or misconduct adversely affects the integrity of the Contest. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Contest. By accepting a prize, winner agrees to release Erickson., their directors, employees, officers, and agents, including without limitation, their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of the prize or participation in any prize-related activities.
10. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
